The General Terms and Conditions of Contract regulate the remote sales relationship between QUIMICA DE MUNGUIA SA and the user or customer, in accordance with legal provisions, particularly Law 7/1998, of April 13, on General Terms and Conditions of Contracting, Law 3/2014, of March 27, amending the revised text of the General Law for the Defense of Consumers and Users, Organic Law 3/2018, of December 5, on the Protection of Personal Data and the guarantee of digital rights, General Data Protection Regulation (EU) 2016/679, Law 7/1996, of January 15, on the Regulation of Retail Commerce, and Law 34/2002, of July 11, on Information Society Services and Electronic Commerce.

Such modifications may be made, through its websites, by any means permissible by law and will be binding during the time they are published on the website and until they are validly replaced by subsequent ones. However, QUIMICA DE MUNGUIA SA reserves the right to apply, in specific cases, Particular Conditions of Contracting with preference to these General Conditions when deemed appropriate, announcing them in due time and manner. The duration of the contract will be linked to the delivery of the product, without prejudice to the right of withdrawal.

QUIMICA DE MUNGUIA SA guarantees the conformity of all products offered on the website for a period of three years from delivery.
In accordance with the General Law for the Defense of Consumers and Users, defects that appear during the first 2 years in new products are presumed to be original, meaning they existed at the time of delivery unless the company can demonstrate that the defect was caused by misuse.

All products display the sale price in euros and include Value Added Tax (VAT).
If any other tax is applicable, it will be indicated (IGIC or IPSI).

Order fulfillment
QUIMICA DE MUNGUIA SA undertakes to deliver the order within a maximum period of 30 days from the day after the order is placed.
The availability of the products offered by QUIMICA DE MUNGUIA SA may vary depending on customer demand. Although QUIMICA DE MUNGUIA SA updates the stock periodically, the product requested by the customer may be out of stock at that time. In the event of non-execution due to unavailability, QUIMICA DE MUNGUIA SA will notify the customer by email as soon as it becomes aware of this situation. The period of this communication will not exceed, in any case, a maximum period of 30 days. QUIMICA DE MUNGUIA SA may give the double option of either supplying the customer with a product of similar characteristics or of equal or superior quality, or, except for justified and demonstrable reasons by QUIMICA DE MUNGUIA SA, refunding the amount of the product canceled.
Right of withdrawal, returns, and claims
The buyer has a period of fourteen calendar days to exercise their right of withdrawal from the contract without having to state any reason and without incurring any costs, except for those provided for in Article 107.2 and 108 of RD1/2007, of November 16, which approves the text of the General Law for the Defense of Consumers and Users.
This right of withdrawal is not applicable to purchases made less than 15 Euros.

Returns due to manufacturing defects of the products or delivery of the wrong product will be accepted. The customer must inform QUIMICA DE MUNGUIA SA of this within 48 hours of receiving the product. QUIMICA DE MUNGUIA SA will cover the costs of return and replacement and will refund the full amount of the product or the customer will be given a coupon for the purchase amount, at their discretion. Returns must be made within a maximum of 30 days from the delivery of the order, accompanied by the receipt or invoice.
In case of dispute, QUIMICA DE MUNGUIA SA is subject to the consumer arbitration system established by law.
The right of withdrawal may not be exercised in the following cases, among others:
1. Products made according to the specifications of the consumer and user or clearly personalized, or which, due to their nature, cannot be returned or may deteriorate or expire rapidly.
2. Unsealed goods after delivery that are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery.
In any case, the products must be returned in their original packaging and in perfect condition, protecting them so that they are received in perfect condition. The corresponding shipping costs will be borne by the customer.
Refund of payment: Refunds of payments made by card or Bizum will be processed using the same means of payment used by the customer to purchase the product, unless otherwise agreed.
Jurisdiction
QUIMICA DE MUNGUIA SA reserves the right to file civil or criminal actions deemed appropriate for improper use of its website and content or for breach of these terms and conditions.
The relationship between the user and QUIMICA DE MUNGUIA SA shall be governed by the applicable regulations in force in Spanish territory. If any dispute arises regarding the interpretation or application of these conditions, the parties will submit to the jurisdiction of the courts of the consumer’s place of residence.
QUIMICA DE MUNGUIA SA shall not be responsible for failure to perform the contract due to force majeure, the occurrence of any fortuitous event, or delays caused by the services contracted with third-party suppliers.
